Membership Agreement

This agreement is concluded between ROTA YALOVA YAPI TEKNİK HIRD. İNŞ. TAAH. SAN. TİC. LTD. ŞTİ. (ShipsBay) and the person or company becoming a member of the shipsbay.com site, by its acceptance during membership registration.

Service

ShipsBay provides a catalog, request-for-quotation and tender environment for ship supply products. No payment is taken through the site for catalog, quotation and tender transactions, and prices are quote-based; only the premium membership may be sold by card, under the Distance Sales Agreement. In sales tenders the site only records the winner; payment and delivery are agreed between the parties.

Membership

The member is responsible for the accuracy and currency of the information provided, for the security of its account and for the transactions carried out through its account. A person who creates a membership on behalf of a company accepts that they are authorised to represent that company. Supplier accounts may bid in tenders after ShipsBay's approval.

Tenders and offers

Tenders and listings are published after ShipsBay's approval; ShipsBay may reject or cancel a listing, stating its reasons. The member agrees not to include a telephone number, e-mail address or other contact details in the listing text.

The supplier submits its offer as a serious offer for the validity period it states. The contract, delivery, payment and quality matters following the winning offer are between the buyer and the seller; ShipsBay is not a party to this relationship.

Prohibited uses

Placing misleading listings or offers, using another person's information without permission, breaching tender confidentiality, impairing the security or operation of the site and sharing unlawful products or content are prohibited. In these cases the account may be suspended or closed.

Intellectual property

The design, software and content of the site belong to ShipsBay or its licensors. The member accepts that the content it uploads belongs to it or that it has the right to use it, and permits its use for the provision of the service.

Liability

The service is provided as is; it is not guaranteed to be uninterrupted or error-free. Map and vessel position data are for information and cannot be used for navigation. ShipsBay is not responsible for the accuracy of members' listings and offers or for commercial transactions between the parties. Liabilities that cannot be limited by law are reserved.

Amendment and termination

ShipsBay may update this agreement; the current text is published on the site. The member may request deletion of its account at any time. In the event of a breach of the agreement, ShipsBay may terminate the membership.

Governing law

This agreement is governed by Turkish law. Yalova courts and enforcement offices have jurisdiction over disputes; the statutory rights of members who are consumers are reserved. Notices are sent to the member's registered e-mail address.
